Welcome to Reset Soma, the online store of Hudson Valley Integrative Health PLLC ("HVIH PLLC", "we", "us"), 291 Main St, Suite 101, Beacon, NY 12508.
These terms are an agreement between you and HVIH PLLC. By using this store or placing an order, you agree to them. If you do not agree, please do not use the store.
Who can buy
You must be at least 18 years old and shopping from within the United States. An adult may buy a product intended for a child, but a child may not order from us directly. You may buy for yourself or your household. You may not buy from this store to resell. We may cancel orders that appear to be for resale, and we may limit quantities.
This is a store, not medical care
Buying from this store does not make you a patient of HVIH PLLC. It does not create a provider and patient relationship, and no one here becomes your clinician because you placed an order.
Everything on this store, including product descriptions and any answer we give you by email or phone, is general information and education only. It is not medical advice and it is not a diagnosis. It does not replace care from your own doctor, nurse practitioner, or pharmacist.
Talk with your own clinician before you start, stop, or change any supplement. That is especially important if you are pregnant or nursing, if the product is for a child, if you take prescription medicine, or if you have a medical condition.
If you think you are having a medical emergency, call 911.
Clinical care, lab orders, and lab test kits are arranged only through a consult with HVIH PLLC and are handled inside the practice's secure systems. Lab test kits are not sold on this store and cannot be added to a cart. Your purchases here are retail transactions. They are not medical records and they are not part of any clinical chart.
What we can and cannot say about our products
We describe supplements in structure and function terms, meaning how an ingredient supports a normal body function. We do not describe them as treatments for any disease.
These statements have not been evaluated by the Food and Drug Administration. These products are not intended to diagnose, treat, cure, or prevent any disease.
Product information, ingredients, and allergens
We work hard to describe products accurately, and even so:
- The label on the bottle you receive is the official information. Manufacturers change formulas, ingredient sources, and allergen statements without telling retailers in advance.
- Read the label every time, including on a product you have taken before.
- Colors, capsule size, and packaging may look different from our photos.
If you have a food allergy, check the label before your first dose. If the label does not match what our page said, do not take it. Contact us and we will make it right under our Refund and Return Policy.
Keep all supplements out of the reach of children. If a child swallows something they should not have, call Poison Control at 1-800-222-1222 or call 911.
Prices, errors, and our right to cancel
Prices are in U.S. dollars and may change at any time. We charge sales tax where the law requires it.
Your order is an offer to buy, not a completed sale. The sale happens when we send your shipping confirmation. Until then we may decline or cancel any order, in whole or in part, including when the item is out of stock, the price or description was posted in error, we cannot verify your billing or shipping information, or we suspect fraud or resale. We are not required to sell at an obviously wrong price. If we cancel, we refund everything you paid for the cancelled items and we tell you why.
Orders, payment, and returns
Payment is taken when you place your order. Our Refund and Return Policy and Shipping Policy are part of these terms. All supplement sales are final, except for damaged, defective, wrong, missing, or undelivered orders. Please read the Refund and Return Policy before you buy.
Your account
If you make an account, keep your password private and your information current. You are responsible for activity under your account. Tell us at orders@resetsoma.com if you think someone else is using it.
Acceptable use
Please do not use this store for anything unlawful, resell our products or claim to be an authorized dealer, copy or bulk download the site, try to break into any part of the site or the accounts of others, upload anything harmful, impersonate anyone, or interfere with the site working normally for other people. We may suspend or close accounts that break these rules.
Reviews and anything you post
If you write a review or send us a photo or story, you keep ownership of it. You give us permission to display and share it in connection with the store and our marketing, without payment.
We ask that reviews be honest and your own real experience. If you received a product for free or at a discount, or if you are connected to us, please say so in the review.
We do not remove a review just because it is negative, we never require you to say nice things about us, and we will not penalize you for an honest review. We may remove content that is unlawful, threatening, off topic, contains someone else's private health information, or claims a product treats a disease.
Our content
The Reset Soma name and logo, the site design, photos, and written content belong to HVIH PLLC or our licensors. You may not copy or reuse them without written permission. Product names and brand names of the products we carry belong to their owners.
Warranties and limits on our responsibility
Please read this section carefully.
Except for what we promise in our Refund and Return Policy, this store and its content are provided "as is". To the fullest extent the law allows, we disclaim all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, and non-infringement. We do not promise the site will always be available or error free. We do not manufacture the products we sell, and any manufacturer warranty comes from the manufacturer.
To the fullest extent the law allows, HVIH PLLC and its owners, staff, and contractors are not responsible for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising out of the store or the products.
To the fullest extent the law allows, our total responsibility to you for any claim connected to the store or a product is limited to the amount you paid us for the product the claim is about.
Nothing in this section limits our responsibility for death or personal injury caused by our negligence, for our gross negligence, fraud, or intentional misconduct, or for anything that cannot be limited under the law that applies to you. Some states do not allow these limits. If you live in one of them, the limits above do not apply to you to the extent your state's law says so, and you may have additional rights.
If we disagree
Talk to us first. Before either of us starts any formal proceeding, the one with the complaint should send a written notice describing the problem and what they want. Send yours to orders@resetsoma.com with the subject "Dispute Notice", or by mail to HVIH PLLC, 291 Main St, Suite 101, Beacon, NY 12508. We each agree to try in good faith to work it out for 60 days. Most problems end here.
Governing law. These terms and any dispute about them or about your order are governed by the laws of the State of New York, without regard to its conflict of laws rules. This does not take away the protection of any consumer law of the state where you live that cannot be overridden by agreement.
Where cases go. You and we agree to the exclusive jurisdiction and venue of the state courts located in Dutchess County, New York, and the United States District Court for the Southern District of New York, and each of us consents to personal jurisdiction there. Either of us may instead bring a qualifying claim in small claims court.
General
Changes. We may update these terms. The version that applies to your order is the version posted when you placed it. Changes never apply backward to an order you already placed.
Severability. If any part of these terms cannot be enforced, the rest still applies.
No waiver. If we do not enforce something right away, we have not given up the right to enforce it later.
Assignment. You may not transfer these terms. We may transfer them to a successor, for example if the business is sold.
Events outside our control. We are not responsible for delays or failures caused by things we cannot control, including weather, natural disasters, strikes, carrier failures, supplier failures, outages, and government action.
Entire agreement. These terms, together with the Refund and Return Policy, Shipping Policy, and Privacy Policy, are the whole agreement between us about this store.
